Terms and conditions of coverage for the Oogwereld Guarantee Plan

These general terms and conditions apply to the purchase and use of the Oogwereld sold OGP.
1. Definitions
In these terms and conditions, the following terms are used in the following meaning, unless expressly stated otherwise or the context requires otherwise.
a. Oogwereld: the user of these general terms and conditions.
Oogwereld Group (all stores belonging to Oogwereld), located at Boogschutter 20, 5215 MJ in Den Bosch, registered with the Chamber of Commerce under Chamber of Commerce number 17192171 & 20070898 & 09044602 & 05060603 & 64541274 & 80730884 & 77034163 & 27306020 & 08049486 & 18123825 &Â 81259999Â &Â 34329471Â &Â 18130736Â companies (hereinafter referred to as Oogwereld).

2. Information about OGP
2.1. Information about (participating in) the OGP will be provided to you at the relevant Oogwereld store. Explanations about the OGP and these terms and conditions can be found in the OGP brochure and also on www.oogwereld.nl
2.2. By purchasing the OGP, you agree to these terms and conditions. This constitutes an agreement with Oogwereld regarding the OGP. The OGP is personal and entitles you to three years of OGP benefits.
3. Use of the OGP
Claiming benefits associated with the OGP can only be done in the store where the OGP was taken out.
4. Payment
The OGP (Owners' Compensation) fee, which is 10% of the gross purchase price, must be paid upon purchase. This is before deducting any discount or reimbursement from your health insurer.
5. Changes
Oogwereld reserves the right to withdraw offers, modify offers, or make new offers at any time and under any circumstances. Information about changes can be found in a brochure or other written document. The date of the relevant document serves as the effective date for the change. OGP participants cannot derive any rights from their knowledge of any change.
6. Validity and claims
6.1. The OGP is valid for a period of 36 months from the date you paid for the glasses for which an OGP was taken out.
6.2. Once the validity period has expired, the OGP is no longer valid. Oogwereld will notify you of this.
6.3. An OGP can only be purchased with glasses and/or lenses that have been paid for in full. A new OGP cannot be purchased with glasses and/or lenses that have already received OGP services.
6.4. If your glasses or lenses are damaged during the term of your OGP, Oogwereld will compensate you for the repair costs as follows:
Each part of the glasses can be claimed once during the policy term. In the event of damage or breakage to glasses, the deductible varies from 0% (year 1) to 50% (year 3) (see reimbursement table) of the original purchase price of the part that needs to be replaced or of the repair costs. This is before deducting any offer and/or reimbursement from the health insurer.Â
6.5. If your glasses are lost or stolen, they will be replaced by new, equivalent glasses fitted with the same or a comparable type of lenses based on the same eye measurement values as those applicable to the lenses being replaced.Â
In the event of loss or theft of glasses, the deductible varies from 25% (year 1) to 75% (year 3) (see reimbursement table) of the original purchase price. This is before deducting any discount and/or reimbursement from the health insurer. Oogwereld will compensate the remaining amount by granting a discount on the new glasses. Proof of reporting the theft to the police and proof of reporting the theft to (www.verlorenofgevonden.nl) In case of loss, this must be reported to Oogwereld.
6.6. If your prescription changes significantly within 3 years, Oogwereld will reimburse you for the cost of purchasing new lenses. The prescription change must be at least 0.5 dpt. The deductible varies from 25% (year 1) to 75% (year 3) (see reimbursement table) of the original purchase price.
6.7. The fee you pay for the OGP covers the additional services you are entitled to. If no additional services are used during the OGP term, you can receive a full refund as an (additional) discount on the purchase of new prescription frames (or prescription sunglasses). The only condition is that new prescription frames or sunglasses are purchased no later than six months after the OGP expires at the location where the subscription was purchased. If this option is not used within the specified period, the option/benefit will automatically expire.
6.8. No cash payments will be made during the entire duration of the OGP or afterward. Reimbursement will always be made in kind, up to a maximum of the net purchase value of the prescription (sun)glasses.
6.9. In the event of an inconvenience, please report it as soon as possible to the Oogwereld branch where you purchased your OGP. Your claim will be processed if your proof of purchase is in our system. If your inconvenience is related to loss, you must provide proof of reporting the incident (filed at www.verlorenofgevonden.nl). In the event of theft, you must be able to provide proof of the report and the police report. If you do not have proof of the report and/or the police report, your claim cannot be processed.
6.10. Oogwereld assumes that any claims are made on the basis of complete, correct and accurate information.
6.11. Claims for compensation linked to the OGP can only be made at the Oogwereld branch where the OGP was taken out.
6.12. While the OGP covers the most common inconveniences for glasses wearers, it does not provide compensation for repair or replacement of glasses due to defects caused by wear and tear, defects caused by improper use, consequential damage, or intentional damage, as determined by Oogwereld.
6.13. Oogwereld emphasizes that the OGP is not an insurance policy supervised by De Nederlandsche Bank (DNB). The OGP's guarantees are based on a guaranteed commitment in the form of additional discounts (compensation) subject to conditions, which prevent OGP customers from incurring additional costs as a result of the inconveniences mentioned in these general terms and conditions.
7. Termination of participation
7.1. Oogwereld reserves the right, without prejudice to all of its rights, to immediately revoke OGP's rights and terminate the agreement in the event of fraud; provision of incomplete or incorrect information; conduct contrary to these terms and conditions; abuse of your rights as an OGP customer; or any other conduct that damages Oogwereld and/or its stores, without Oogwereld being liable for any damages or costs.
7.2. Oogwereld reserves ownership of the delivered goods until they have been paid for in full.
8. Termination of program
Oogwereld reserves the right to terminate the agreement, which includes discontinuing the OGP. Information regarding this will be provided to you in a brochure or other written document. In that case, Oogwereld is in no way obligated to compensate for any damages or costs that may arise in any way as a result.
9. Miscellaneous
Oogwereld reserves the right to amend these terms and conditions. On the effective date of the amended terms and conditions, these and all previous terms and conditions will lapse. This agreement is governed by Dutch law. Any disputes arising from this agreement will be submitted to the competent court in the district of Haarlem, which will then settle the dispute exclusively, unless mandatory legal rules dictate that a different court have jurisdiction.
